On March 7, 2012 the Canadian Radio-television and Telecommunications Commission (CRTC) published its final regulations, which provide details on the required contact information and unsubscribe mechanism to be included in each commercial electronic message and the requirements for valid consent. The second round of draft Industry Canada regulations are expected to be released for a 30-day comment period in September or October 2012.
On October 10, 2012 the Canadian Radio-television and Telecommunications Commission (CRTC) published two Information Bulletins regarding CASL. The first bulletin provides further interpretation and examples of the requirements around gathering express consent. This bulletin also provides further clarification around what information needs to be included in CEMs, how the unsubscribe mechanism needs to function and requirements for collecting express consent. The second bulletin provides guidelines around the use of toggling to obtain express consent under CASL.
On January 5, 2013 Industry Canada published their revised draft CASL Regulations in the Canada Gazeette for a 30 day comment period.
Once the Industry Canada regulations are finalized, CASL will become fully implemented and enforceable. CASL will likely be proclaimed into force mid-2014.
